Terms of Service — Server Assistant

These terms govern your use of the Server Assistant Discord bot (“the Bot”) in any Discord server where it is installed. By inviting the Bot to a server, the server owner (“you”) agrees to these terms on behalf of that server’s members.
1. Acceptance
You accept these terms by inviting the Bot to a server you own or administer. Continued use of the Bot constitutes ongoing acceptance.
2. Eligibility
You must be at least 13 years old (or the minimum age required by Discord in your jurisdiction) to invite or use the Bot. You must comply with Discord’s Terms of Service and Community Guidelines at all times.
3. Permitted use
The Bot is provided for legitimate moderation and community-management purposes within Discord servers. You agree to use the Bot only as intended and not to:
- Use the Bot to harass, dox, threaten, or harm any user
- Use the Bot to violate Discord’s Terms of Service or Community Guidelines
- Use the Bot to circumvent Discord’s rate limits, anti-spam systems, or other technical safeguards
- Reverse-engineer, decompile, or attempt to extract the Bot’s source code or stored secrets
- Interfere with or disrupt the Bot’s operation in other servers
- Resell, sublicense, or redistribute the Bot without explicit written permission
4. Server-owner responsibility
You are solely responsible for:
- Moderation decisions made through the Bot in your server
- The accuracy of warnings, notes, and other moderation records you create
- Configuring appropriate roles, permissions, and channels
- Communicating the Bot’s privacy policy to your server’s members (or linking to it in a public channel)
- Ensuring your server complies with applicable laws
The Bot is a tool; final accountability for any moderation action rests with the staff member who invoked it.
5. AI features
The Bot offers optional AI features powered by third-party providers (xAI Grok, OpenAI, etc.):
- AI-generated content (moderation summaries, image generation) is not guaranteed to be accurate or appropriate
- You are responsible for reviewing AI output before relying on it for moderation decisions
- AI providers may store transmitted data per their own privacy policies
- The Bot’s operator does not guarantee continued availability of any specific AI provider
If you provide your own AI API keys (BYO mode), you are responsible for any costs incurred with that provider.
6. No warranty
The Bot is provided “as-is” without warranty of any kind. The Operator makes no representations or warranties:
- That the Bot will be uninterrupted, secure, or error-free
- That AI-generated content will be accurate or fit for purpose
- That data stored by the Bot will not be lost (although we make reasonable efforts)
- That the Bot will be free from defects, vulnerabilities, or unauthorised access
You use the Bot at your own risk.
7. Limitation of liability
To the maximum extent permitted by law, the Operator shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Bot, including but not limited to:
- Lost data, lost members, or lost revenue
- Erroneous moderation actions
- Data breaches affecting third-party AI providers
- Discord platform outages or changes affecting the Bot’s behaviour
In no event shall the Operator’s total liability exceed the greater of (a) the amount paid for premium features in the last 12 months, or (b) ten US dollars (USD $10).
8. Termination
You may stop using the Bot at any time by removing it from your server. The Operator may terminate or suspend the Bot’s availability to your server at any time, with or without notice, for:
- Violation of these terms
- Violation of Discord’s Terms of Service
- Abuse of Bot features that affect other servers
- Decommissioning of the Service
Upon termination, the Bot will wipe encrypted secrets associated with your server. Other data (warnings, notes, audit log) will be deleted upon request per the Privacy Policy.
9. Premium features (when available)
When the Bot offers paid premium features through the Discord App Directory:
- Subscriptions are billed and managed by Discord
- Payment, refunds, and tax are handled exclusively by Discord
- Premium entitlements apply only to the server that purchased them
- Cancellation, refund eligibility, and billing disputes are governed by Discord’s commerce terms
10. Changes to these terms
The Operator may update these terms to reflect changes in the Bot’s features, legal requirements, or industry practice. Material changes will be announced in the Bot’s support server. Continued use after changes take effect constitutes acceptance.
11. Governing law
These terms are governed by and construed in accordance with the laws applicable to the Operator’s jurisdiction. Any disputes arising under these terms shall be resolved in the courts of that jurisdiction.
12. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
